facade cannot exceed 12 meters or 3 floors, except in situations
compliance with a duly established facade height
for the respective urban front and for the cases referred to in § 4 of the
this article;
c) In both cases of the previous paragraph, the waterproofing index
of the soil cannot be more than 80%."
"Article 38 - Identification and uses
Agricultural and forestry multiple-use spaces comprise the systems
agrosilvo-pastoral and agricultural and silvicultural uses functionally
complements that, in addition to their productive importance, play a
important role in environmental and landscape balance.
Article 39 - Buildability regime
The buildability of these spaces, without prejudice to the provisions of legislation
specific rules in force and the safeguard principles established
in this Regulation, is restricted to the following cases:
a) Facilities for direct and exclusive support of agricultural or
livestock, provided that:
i) The utilization index does not exceed 0.02 of the exploration area,
allowing a minimum of 50 m² of construction area.
ii) The height of the facade does not exceed 7 meters, except for reasons of
technical order.
b) Installations for processing agricultural or livestock products,
provided that:
i) The maximum implantation area does not exceed 800 m², unless
exceptional cases of technical-economic interest recognized by the
City Hall and demonstrated the correct landscape integration in the
territory;
ii) The height of the facade does not exceed 7 meters, except for reasons of
technical order.
c) Construction, expansion and alteration of buildings for residential purposes,
under the following conditions:
i) New buildings are located in the area least harmful to
agricultural activity;
ii) The land use index does not exceed 0.04 of the building area,
except in construction situations between existing buildings at one and
on the other side of the same bank of a given public road and which are
less than 100 meters apart, in which case the maximum waterproofing area
of the ground cannot exceed 300 sqm;
iii) The height of the facade does not exceed 7 meters, except when the slope
of the land allows for underground construction up to a maximum height
at the most unfavorable point of 9 meters, as long as solutions are properly
integrated into the landscape.
d) Construction, expansion and alteration of buildings for tourist purposes,
of sport or leisure or for equipment for collective use, in
following conditions:
i) The land use index does not exceed 0.07 of the building area,
without prejudice to the expansion area of existing buildings reaching
50% of the original construction area;
ii) The height of the facade does not exceed 7 meters, except in the case of the slope of the
land provides basement construction with an unobstructed facade
up to a maximum height of the facade, at the most unfavorable point, of 9 meters,
or even in the case of structures with special technical requirements,
as long as the solutions are properly integrated into the landscape."
